1. Acceptance of Terms
By accessing or using the iSeeWell website and services ("Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, you must not use the Platform. These Terms constitute a legally binding agreement between you and 16841082 Canada Inc., operating as iSeeWell, with its principal office at 1200 Derry Rd E #4, Mississauga, ON L5T 1B6, Canada.
2. Description of Service
iSeeWell is an online platform that connects patients with optometry clinics across Canada. We facilitate the discovery of clinics, the viewing of available services, and the submission of appointment requests. iSeeWell is not a healthcare provider and does not provide medical advice, diagnosis, or treatment.
3. Eligibility
You must be at least 13 years of age to use our Platform. Individuals between 13 and the age of majority in their Canadian province or territory (18 in Ontario) may use the Platform only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on the minor's behalf and accepts responsibility for all use of the Platform by the minor.
4. User Accounts & Responsibilities
When booking or creating an account, you agree to provide accurate, current, and complete information. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
5. Appointments & Bookings
iSeeWell facilitates appointment requests between you and independent optometry clinics. We do not guarantee appointment availability or acceptance. Clinics set their own schedules, fees, cancellation policies, and terms of service. Any disputes regarding services rendered are between you and the clinic. You agree to honour appointments or cancel within a reasonable timeframe as specified by the clinic.
6. Clinic Listings
Clinic information displayed on iSeeWell is provided by the clinics themselves or sourced from publicly available data. While we strive for accuracy, we do not warrant that clinic details (including hours, services, insurance acceptance, or pricing) are complete or current. Clinics are independent businesses and are solely responsible for the services they provide.
7. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose
- Submit false or misleading information
- Interfere with the operation of the Platform
- Attempt to gain unauthorized access to any systems or accounts
- Harvest or collect personal information of other users without consent
- Use automated tools (bots, scrapers, crawlers) to access or interact with the Platform without our written consent
- Impersonate any person or entity
- Use the Platform to transmit viruses, malware, or other harmful code
8. Intellectual Property
All content, trademarks, logos, and intellectual property on the Platform are owned by or licensed to iSeeWell and are protected by Canadian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
9. Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. iSeeWell does not provide medical advice. Information on the Platform is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified eye care professional.
10. Limitation of Liability
To the maximum extent permitted by applicable Canadian law, iSeeWell and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of data, revenue, or profits. Our total aggregate liability for all claims related to the Platform shall not exceed the greater of (a) the amount you paid to iSeeWell, if any, in the twelve (12) months preceding the claim, or (b) one hundred Canadian dollars (CAD $100).
11. Indemnification
You agree to indemnify and hold harmless iSeeWell, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
12. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial legislation. 13. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada, located in the Regional Municipality of Peel.
14. Dispute Resolution
Before initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at contact@iseewell.com. If the dispute is not resolved within thirty (30) days, either party may pursue resolution through the courts of Ontario, Canada, or through mutually agreed-upon mediation.
15. Modifications to Terms
We reserve the right to update these Terms at any time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the revised Terms. If you do not agree with any changes, you must discontinue use of the Platform.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and iSeeWell regarding your use of the Platform and supersede any prior agreements or understandings.
